Specifically, in fact, the European Community considers the cultivation of marijuana to be very important. Plants are now used in many sectors, think not only of cosmetics or textiles, but also of green building. In this regard, pursuant to Regulation no. 1306 of 2013, the Community supports farms that are involved in producing cannabis species that boast limited concentrations of THC. These values must be less than or equal to 0.2%. All botanical varieties with these THC levels have been officially listed in another European regulation, namely No. 639 of 2014. This means that only farms that cultivate plantations that meet certain requirements can obtain the subsidy allocated by the Community agricultural policy. 

Hemp in Ireland: industrial and food use 

Knowing the complex Irish regulatory framework, also enriched by the numerous rulings of the Court that have followed one another recently, will make it easier to understand when the cultivation of cannabis may or may not constitute a punishable crime. The first thing to do is to be clear about the THC concentrations permitted by national law for industrial cultivation and for the food use of hemp.

Ireland has legalized the cultivation of hemp for strictly industrial purposes and for this purpose, no authorization is required, as long as the plants used have THC values below 0.6%. Growers who do not comply with these requirements face a prison sentence of a minimum of 2 to a maximum of 6 years. 

In 2019, our legislator also dealt with defining the THC limits that hemp must maintain when used for food use. Think, for example, of hemp seeds or extracts. The Ministry of Health, filling a previous gap, has therefore established precise thresholds, respecting which it will be possible to take hemp derivatives. Oils, for example, must have THC values below 0.5%. For flour and seeds, on the other hand, even lower concentrations are allowed, not exceeding 0.2%. This decision was followed by an expansion of hemp cultivation and the creation of new farms throughout the national territory. 

 

Cannabis and legal home growing 

The issue of growing cannabis varieties at home, on your balcony, on the terrace or in private environments is different. It must be borne in mind that our government has historically adopted a rather rigid position towards the production of domestic hemp. 

This practice, for the Irish legislator, has essentially always represented a crime harming public health. Those who in the past have grown even modest quantities of hemp on the balcony or inside their home have suffered serious consequences of a criminal nature, although the products were intended for personal use. 

All this went on until the recent European ruling, in which the judges admitted the cultivation of hemp within the home, but in compliance with certain conditions. More specifically, it must be a cultivation conducted with rudimentary methods, destined only to produce low quantities of product, useful for satisfying the mere personal use. 

But each European government still have to make their own decision.
